By accessing or using IndieRadar (“Service”), operated at indieradar.app, you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

IndieRadar is a curated daily newsletter service for indie hackers. Our Service includes:

• Daily email newsletters containing curated content about indie hacker activities, product launches, revenue updates, and industry insights
• A web dashboard to manage your preferences, delivery time, and content categories
• Access to archived newsletter history

3. Account Registration

To use our Service, you must:

• Provide a valid email address
• Be at least 16 years of age
• Provide accurate and complete information
• Maintain the security of your account by not sharing access with others

We use passwordless authentication (magic links) for secure access. You are responsible for maintaining the security of your email account.

4. Free and Paid Services

IndieRadar currently offers a free tier providing:

• Daily curated newsletters
• Category customization
• Delivery time preferences
• 30-day newsletter archive

We may introduce paid features in the future. Any paid services will be clearly communicated, and you will not be charged without explicit consent.

5. Content and Intellectual Property

5.1 Our Content

The IndieRadar name, logo, website design, and original content are the property of IndieRadar. You may not copy, modify, distribute, or create derivative works without our express written permission.

5.2 Curated Content

Our newsletters contain curated summaries and links to third-party content (primarily from Twitter/X). We provide brief summaries and proper attribution. The original content remains the property of its respective creators. We do not claim ownership of summarized or linked content.

5.3 Featured Profiles

Indie hacker profiles featured on our landing page are displayed with permission or based on publicly available information. If you'd like your profile removed, please contact us.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service in a manner that sends more requests than a human can reasonably produce
• Distribute spam or unsolicited communications
• Impersonate others or provide false information
• Resell or redistribute our newsletter content commercially without permission

7. Email Communications

By creating an account, you consent to receive emails from us including:

• Daily newsletters (based on your preferences)
• Transactional emails (magic links, confirmations)
• Service announcements (policy changes, new features)

You can pause or unsubscribe from newsletters at any time through your dashboard or via the unsubscribe link in each email.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

9. Content Accuracy

We use AI-assisted curation to summarize and categorize content. While we strive for accuracy, we do not guarantee that all information in our newsletters is complete, accurate, or current. Content is provided for informational purposes only and should not be considered professional advice.

10. Third-Party Links

Our newsletters contain links to third-party websites and content. We are not responsible for the content, accuracy, or practices of these external sites. Clicking external links is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

• IndieRadar is provided “as is” without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim

12. Indemnification

You agree to indemnify and hold harmless IndieRadar and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Account Termination

By You: You may delete your account at any time through the dashboard settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. We will provide notice when possible.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation.
